Welcome to the Melbourne IT Support Community. This is a place provided by Melbourne IT for our users and customers, to help with the exchange of ideas, tips, techniques and constructive discussions relating to our products and services. By accessing and using the Melbourne IT Support Community, you agree to comply with these Terms of Use, including the Melbourne IT Privacy Policy and any other terms and conditions or policies set out on the Melbourne IT Support Community or on our main website at http://www.melbourneit.com.au/. Privacy

The Melbourne IT Support Community is a place of sharing and learning, and above all, a public place for collaboration. It is important you respect the privacy of other users, and also protect your own. If you notice any offensive or inappropriate postings or behaviour, you can report these by selecting the confidential "Report Inappropriate Content" link under the 'Options' menu on the applicable post.

Appropriate Conduct and Responsibility

You are solely responsible for all posts you make in the Melbourne IT Support Community, and for exercising careful judgment in evaluating and taking action based on other users' posts. Posts will be made by various users with differing levels of technical experience and competency - from beginning novices to experienced users - and Melbourne IT is not responsible for the accuracy of posts in the Melbourne IT Support Community. You agree you assume the risk of reading and acting upon any information posted in the Melbourne IT Support Community by any users.

Participation, Suspension, Banning and Disputes

The Melbourne IT Support Community is a place for users to connect, collaborate and assist each other. It is important for all users to be respectful of other users, and the Melbourne IT Support Community as a whole. We may edit or remove any posts which, in our sole discretion, we consider violate the Terms or which we consider inappropriate for any reason. We may also amend your username or remove your username from any posts at our discretion. Lastly, if we believe you have violated the Terms, we may also restrict or suspend your use of the Melbourne IT Support Community or even ban you, without notice.

In the event we take any of the action outlined in the Terms, our decision to do so will be final and we will not be obliged to provide you with reasons or enter into correspondence with you regarding our decision.

While we hope no disputes arise between you and any user, we have no obligation to resolve any such disputes should they arise.

Accounts

It is important that all information you provide to us is accurate, complete and up to date. We may suspend or terminate your account and access to the Melbourne IT Support Community if information provided is found to be inaccurate, incomplete or out of date.

You do not need an account to read postings in the Melbourne IT Support Community, only if you want to contribute.

Modification, Suspension or Discontinuance of the Support Community

We reserve the right to modify, delete, suspend or discontinue the Melbourne IT Support Community (including postings) at our discretion and with or without notice. We may update the Melbourne IT Support Community from time to time as we see fit.

Indemnity

You indemnify Melbourne IT and its licensors from and against all claims, damages, losses, proceedings (whether legal or administrative) and expenses (including but not limited to reasonable legal fees) incurred by Melbourne IT or its licensors arising in connection with (i) any personal information (whether belonging to you or another person) you disclose and/or solicit in the Melbourne IT Support Community, and (ii) any resulting use of such personal information by you or any third party (whether such use was permitted by you or not).

Liability and Disclaimer

We acknowledge that certain jurisdictions do not allow the exclusion or limitation of warranties or liabilities, and we accept that in such jurisdictions the following limitations or exclusions may not apply to you. In such jurisdictions, if permitted by applicable legislation, the liability of Melbourne IT and its licensors shall be limited, at our option, to resupplying, repairing or replacing the relevant goods or services (or payment of the cost of resupply, repair or replacement).

Subject to the foregoing, you agree that:

  1. Most of the content posted to the Melbourne IT Support Community is provided by third parties not affiliated with Melbourne IT. We have no liability to you for any loss incurred by you or any other party in relation to any content, information or third party websites accessed and/or relied upon via the Melbourne IT Support Community;
  2. The Melbourne IT Support Community is provided "as is", and we do not warrant that any content or information in the Melbourne IT Support Community is accurate, reliable, complete or error free (regardless of who has originated that content) or that the Melbourne IT Support Community is error free or will operate uninterrupted. To the extent permitted by law, we exclude all warranties, terms and conditions, express or implied, relating to the Melbourne IT Support Community and your use of the Melbourne IT Support Community; and

Notwithstanding the above, we will not be liable to you for any loss or damage to the extent caused by you, or to the extent such loss or damage results from any failure by you to take reasonable steps to avoid or minimise your loss.

Modification of Terms

We reserve the right to modify the Terms at any time, effective 30 days after publication of the updated Terms on the Melbourne IT Support Community or our main website http://www.melbourneit.com.au/.. We recommend you review the Terms regularly to ensure you are aware of the latest updates. Any continued use of the Melbourne IT Support Community after any Terms have been updated will constitute your acceptance of the updated Terms.

Legal Stuff

If there is any inconsistency between these Terms of Use, and any other applicable terms, these Terms of Use will prevail. These Terms of Use do not create a partnership, joint venture, agency or employer-employee relationship between you and Melbourne IT. If any provision in the Terms is held to be invalid, unenforceable or illegal then it is severed and the remainder of the Terms shall remain in full force. You must not assign your rights and obligations under these Terms of Use without our express prior written consent. A provision or, or right created under these Terms of use, may not be waived except in writing by the party granting the waiver, or varied except in writing signed by Melbourne IT and you. The law in force in the State of Victoria, Australia governs these Terms of Use.
